Challenge for you

  • Why doesn’t the warning say: “…offenders are liable to imprisonment”?
  • Is there unnecessary duplication between may and liable (bearing in mind that liable to a penalty means likely to be punished by law)
  • If there is duplication, could this be intentional in the sense that KMB would like to play down the likelihood of imprisonment?

    1.  A person who fails to comply with-
      1. any provision of section 6AB; or
      2. any condition imposed on a validated production notification,

commits an offence and is liable on conviction to a fine of $500,000 and to imprisonment for 2 years.
